These terms apply to your use of cartlumen.com, cartlumen.ca and the deal posts and links we publish (together, the "Service"). The Service is operated by 1001768665 Ontario Inc., doing business as Cartlumen ("Cartlumen", "we", "us"). By using the Service, you agree to these terms. If you do not agree, please do not use it.
1. What Cartlumen does
Cartlumen finds and shares deals on electronics and related products from third-party retailers in Canada and the United States. We do not sell products. When you click a deal, you go to the retailer's website, and any purchase is between you and that retailer under the retailer's own terms, prices, shipping, return and warranty policies.
2. Prices and accuracy
We try to post accurate information, but prices, promo codes, stock and product details are set by retailers and can change or end without notice, sometimes within minutes. Deals may also be limited by region, quantity or account. We do not guarantee that any deal is available, accurate, or the lowest price, and we are not responsible for a retailer's errors, cancellations or price changes. Always check the details on the retailer's site before you buy.
3. Affiliate links
Many links in the Service are affiliate links, and we may earn a commission from qualifying purchases at no extra cost to you. See our affiliate disclosure for details.
4. Acceptable use
You agree not to:
- use the Service for anything unlawful, or in a way that breaks a retailer's terms;
- copy, scrape or republish our content or links in bulk, or remove, change or replace our tracking links;
- interfere with the Service, its security or other users, including with bots, malware or excessive automated requests;
- pretend to be Cartlumen or misrepresent your connection with us.
5. Our content and brand
The Service's text, design, logos and the Cartlumen name belong to us or our licensors and are protected by copyright and trademark law. You may share links to our pages and posts for personal, non-commercial use. Retailer names, product names and logos belong to their owners, and using them does not mean they endorse Cartlumen.
6. Third-party websites
The Service links to websites we do not control. We are not responsible for their content, products, security or privacy practices. Your use of those sites is at your own risk and under their terms.
7. Not professional advice
Our guides and deal descriptions are general information only. They are not financial, legal, tax or professional advice, and you are responsible for your own buying decisions.
8. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, including Ontario's Consumer Protection Act.
9. Limitation of liability
To the fullest extent the law allows, Cartlumen and its directors, officers and employees are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service or any purchase from a retailer. Our total liability for any claim related to the Service is limited to CAD $100.
10. Indemnity
You agree to indemnify Cartlumen against claims, losses and costs, including reasonable legal fees, that arise from your breach of these terms or your misuse of the Service.
11. Changes and ending access
We may change, suspend or stop any part of the Service at any time. We may update these terms, and the date at the top shows when they last changed. If you keep using the Service after a change, you accept the updated terms. We may restrict access for anyone who breaks these terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree that the courts in Toronto, Ontario have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim in your local courts.
13. General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we can still enforce it later. These terms, together with our privacy policy and affiliate disclosure, are the whole agreement between you and us about the Service.
